So that his wife, Aquilla Wilson Day, who lived in Virginia, could join him in Caswell County, Thomas Day successfully petitioned the North Carolina General Assembly to admit her to the state. North Carolina law prohibited the migration of free blacks into the state. Despite his status as a free person of color, Day owned slaves.
